Andes STR FL, LLC Rental Agreement
The provisions set forth in this Rental Agreement ("Agreement"), govern the customer / renter ("you, "your") obligations and liabilities with Andes STR FL, LLC, a Florida limited liability company ("Andes", "we", "our", "us"). Please read this Agreement carefully. By reserving a stay, confirming a reservation, or staying at one of our properties, you indicate that you accept these terms and that you agree to abide by them. Your submitted reservation and/or reservation inquiry constitutes your acceptance of these terms, which takes effect on the date of which you submit a request. If you do not agree with these terms in full, you should not submit any reservation requests. All guests (primary, secondary, authorized, and unauthorized) occupying any of our properties ("Guests"), must abide by the terms of this Agreement. All provisions of this Agreement that by their nature survive termination of the Agreement, including, but not limited to, all limitations on liability, ownership, indemnification obligations, agreements to arbitrate, choices of law, and other property and intellectual property protections shall survive the expiration, cancellation, or termination of this Agreement.
You understand and agree that this Agreement incorporates (i) our Privacy Policy, which applies to the general use of this website and third-party websites featuring our properties, and (ii) any information pertaining to a stay at one of our properties.
Andes maintains the right to modify these Agreement terms from time to time. Amendments and modifications to this Agreement will be effective upon Andes' posting of such updated terms on its website. Your continued access or use of the Andes services after such posting confirms your consent to be bound by the amended Agreement.
Booking Policies
- Guest making booking must be at least 25 years old.
- Confirmation email will be sent after booking.
- Check-in instructions sent 3 days prior to arrival.
- Certain properties may require signing a waiver.
- You agree to pay all costs (nightly rate, fees, taxes) prior to check in. Booking not confirmed until paid in full.
- Andes may allow a "hold" on booking without full payment, subject to cancellation at any time.
- Additional costs may apply (modifications, add-on services, housekeeping, amenity fees, pool heating, pet fees). Right to assess property damages and cleaning fees including from animals.
- Early check-ins may be requested but not guaranteed.
- Late check-outs may be requested but not guaranteed.
- Check-in instructions provided only upon full payment, identity verification, and applicable screening waivers.
Payment Requirements
- 50% due at booking, remaining 30 days before check-in. Full amount for bookings less than 30 days prior.
- Valid credit card required. You authorize charges for incidental/consequential charges.
- Outstanding charges subject to up to 5% late payment fees.
- Taxes (sales, hotel occupancy, transient, tourist, lodging) may be added. Taxes vary by locality and may change.
Property Condition
You assume responsibility to examine Accommodation on arrival. Notify Andes of anything in disrepair. No express or implied warranty on condition.
Maintenance Requests
Andes makes reasonable effort for repair/maintenance. No guarantee of resolution during stay. No refunds for interruptions.
Incidental and Consequential Charges
Liable for costs/damages during stay (property damage, cleaning, unauthorized amenity usage, regulatory fines, lock replacements, unauthorized guests/animals, exceeding guest count, theft, material breach). Right to charge within 30 days after check-out.
Accidental Damage Protection Program
For US properties without damage deposit: non-refundable ADP Fee. Covers up to $1,500 in aggregate for accidental damage (not from pets, smoking, exceeding occupancy, tampering, intentional/reckless/negligent violations). Responsible for anything not covered or exceeding $1,500.
Chargebacks
Fraudulent chargebacks: fully responsible for collection costs, interest, attorneys' fees.
Cancellation and Refund Policies
Vary by platform. Third-party policies apply. Otherwise, follow Appendix refund policies.
Amenity Refund Policy
No refunds for amenity concerns (pool heating, hot tubs, appliances, internet, AC).
Force Majeure
Not liable for modifications/cancellations due to acts of God, weather, connectivity, evacuations, pandemic, civil unrest, fire, flood, storm, earthquake. No refunds.
Cancellations by Andes
Rare event cancellations (maintenance, safety, double-booking, etc.): substitute property offered or full refund.
Reservation Change Policies
Changes may differ by geography, follow Appendix policies.
Property Rules
- Acknowledge all Property Rules and Guest Manual rules.
- Violation of ordinances/HOA rules may result in removal, cancellation, fines.
- Use reasonable care securing Accommodation and belongings.
- Be respectful of neighbors.
- No pets unless listing permits and agreed prior to booking. Pre-approved pets subject to fee/deposit. Unauthorized pet: $150/day fine plus deep cleaning. Service animals allowed per law.
- No smoking anywhere on premises (including outdoor). Up to $500 fee.
- Accommodation delivered professionally cleaned. No nightly housekeeping. Mid-stay clean required after every 14 days for 20+ night bookings.
- No illegal, nuisance, hazardous, or dangerous activities.
- No physical alterations.
- No firearms or dangerous weapons. No fighting.
- No fireworks. No hazardous/flammable materials except designated firewood/charcoal/propane. Up to $1,000 charge plus damages.
- Water amenities safety rules (no diving, no glass, no intoxicated use, no unattended children, spa/hot tub must be covered when not in use, up to $100 fine).
- No commercial activity/photography without 48-hour advance authorization. Unauthorized commercial recordings: forfeit all proceeds.
- No charcoal/propane grills without authorization.
- No tampering with technology/amenity setups (electrical, HVAC, pool/hot tub systems).
- HVAC thermostat between 70-78 degrees.
- Abide by parking instructions and restrictions.
- Cannot exceed authorized guest count. $250/person/day for each over occupancy.
- In detached Accommodations, all trash in bins. In apartment/condo, use building trash chute.
- Upon departure, leave all keys/access fobs, vacate parking/storage.
- Contact Andes at earliest convenience for any issues.
- Andes not responsible for packages shipped to Accommodation.
Events/Parties
No unauthorized events/parties. Defined as party if: exceeding guest count, noise beyond reasonable, violation of regulations/HOA, disruptive to neighbors. Quiet hours 9pm–8am unless specified.
Property Regulations
Comply with all applicable laws. Comply with HOA bylaws. Liable for fines. Violations may result in immediate cancellation. No refunds for regulation violations.
Anti-Disparagement
Agree not to injure Andes' reputation, endorse untrue statements, make disparaging remarks. Applies to verbal, written, or online communications.
Security Measures
Properties may have 24/7 video surveillance (exterior), smoke/fire/security alarms, sound monitoring. Consent to use. No tampering/disabling/unplugging/relocating.
Transient Occupancy
Transient occupants, not tenants. Not a lease, no landlord-tenant relationship. Andes retains possessory/access/legal rights. Right to enter with reasonable notice.
Holdover Clause
No staying past check-out without authorization. 60 minute grace period after notice to vacate. Liable for vacate fees, lost profits, alternative housing costs, plus 2x undiscounted daily rate per day of holdover.
Late Check-Out Policy
Contact Customer Service with as much notice as possible. Not guaranteed. Unauthorized late check-out: additional half-day at listed rate.
Lost and Found Items Policy
Guest pays 100% shipping/handling plus up to $25 convenience fee.
Assignments and Subleases
No assignments or subletting allowed.
Conflicts with Third-Party Agreements
Applies to bookings on third-party platforms (Airbnb, VRBO). Third-party platform terms supersede conflicting terms in this Agreement.
Waiver of Liability
Andes not liable for loss/damage of personal property or vehicles. Doesn't insure against losses from theft/vandalism/criminal/negligent acts. No indirect, incidental, consequential, exemplary or punitive damages.
Indemnification
Defend, indemnify, hold harmless Andes from claims arising from breach, property damage, negligence/misconduct of Guests/visitors/contractors. Exception: Andes' own gross negligence or willful misconduct.
Andes Assignment
May assign this Agreement at any time without limitation.
Intellectual Property Rights and License
Website and Content are property of Andes/affiliates/licensors. Protected by copyright/trademark. Personal noncommercial use only. No unauthorized modification/copying/republishing/uploading/selling/reverse engineering. No using Content to disparage. No scraping/crawling/automated extraction.
Legal Disputes and Severability
Governed by laws of Accommodation location. Binding arbitration using English language, administered by AAA or ICDR. Waive right to jury trial and class action. Arbitration in county of Accommodation.
If any provision held invalid, remainder survives. If material alteration, indemnity and monetary obligations survive.
COVID-19 Safety Acknowledgement, Liability Waiver and Release
Acknowledge health dangers, assume risk of exposure. Measures to prevent spread borne by you. Release Andes from COVID-19 liabilities.
Appendix – Cancellation Policy
US Properties: Full refund 30+ days prior. Full refund within 48hrs of booking if 14+ days from check-in. 50% refund 7–30 days prior. No refund less than 7 days. No refunds for delayed travel/flights/personal emergencies/weather/COVID.
Chile Properties: Full refund 14+ days prior. Full refund within 48hrs of booking if 14+ days from check-in. 50% refund 7–14 days prior. No refund less than 7 days. Same exclusions.
Appendix – Reservation Change Policy
US Properties: Free changes 30+ days prior (subject to availability). 25% admin fee for 7–30 days prior. No changes less than 7 days.
Chile Properties: Free changes 14+ days prior (subject to availability). 25% admin fee for 7–14 days prior. No changes less than 7 days.
